RULES


Art. 1. Promoter

Art. 2. Participation Requirements

The competition is open to all photographers (professional and non-professional) who have reached the age of 18 by the closing date of the competition, without restrictions of gender, nationality or residence.
Employees of Pixelized.ch Sagl and the sponsors, members of the jury, as well as relatives up to the second degree and partners are excluded.


Art. 3. Duration of the competition

Details on the timing are indicated on the contest page.
The deadline may be extended. Voting and publication dates are indicative.


Art. 4. Prizes

- 500€ cash prizes offered by Fotocontest.it: of which 300€ to the 1st place winner (1 winning photograph) and 50€ each to the four (4) finalists (4 finalist photographs)
- one (1) annual Platinum subscription to fotocult.it (worth €25) to the 1st classified and the four (4) finalists, for a total of 5 subscriptions (€125)
- one (1) copy of the book (indicative value €30) to the 1st place winner and the four (4) finalists, for a total of 5 books (indicative value €150)
Total prize money (indicative): €775

No prize, unless explicitly defined, will be paid in cash.
The cash prize will be sent to the winner by bank transfer, any bank charges or commissions will be borne by the recipient and deducted directly from the intermediary (e.g. the bank).

Note on the photo book:
This will be designed and produced once the contest is over. When all details are available, a pre-sale will be opened with all technical information about the book.
The winner (1) and the finalists (4) will receive a free copy when this is printed. It will of course be possible for them and all the others to buy copies to give to friends and relatives.


Art. 5. Composition of the Jury

The members of the jury are decided by the Promoter and are indicated on the competition page.
The vote cast by the jury is final and irrevocable.


Art. 6. Registration

Registration for the competition is exclusively via the web at www.photocontest.ch.
Participants must provide a valid e-mail address and fill in the form with their real personal data.
The promoter may request a copy of a valid identity document at any time to verify the correctness of the data. The entry of incorrect or untrue personal data when registering on the site will result in exclusion from the competition.
Registration shall also remain valid for future competitions on www.photocontest.ch.


Art. 7. Competition registration fee

The registration fee must be paid by credit card via the photocontest.ch website.
The registration fee is not reimbursed if the participant withdraws or is not admitted to the competition.


Art. 8. Participation in the competition

Each entrant may participate with one or more individual photographs.
The theme, if any, is indicated on the competition page

Format of images to be uploaded via the web at www.photocontest.ch:
- JPEG, saved in high quality (at least 8)
- colour space: Adobe RGB 1998
- long side at least 3500 pixels
- maximum size of 5MB

It is not permitted to include the author's name, watermark, borders/frames or other elements on the image.
A higher quality file must be provided promptly upon request of the promoter.
It is not permitted to include the author's name and/or biography and/or other references to the author in the submitted texts.

At the participant's request, the photograph may be removed after confirmation of participation by contacting the promoter's technical team. This operation is equivalent to the participant giving up. In order to submit a new photograph, the participant must again pay the entry fee in full.
Removal cannot be requested after the competition has closed.


Art. 9. Admission

Admitted/not admitted photographs meet the criteria of the Fotocontest.co.uk regulations as well as the other criteria specified in these regulations. In the event of a discrepancy between the two regulations, the latter (on photocontest.ch) shall take precedence.
After confirmation of receipt of the participation fee, the promoter will make a selection of the entries, admitting and publishing only those works that comply with the regulations.
The promoter reserves the right to refuse or exclude entries at its own discretion, even after having already accepted the participation.
Admitted participants will be notified automatically by e-mail.


Art. 10. Selection - preliminary phase

Each member of the jury will assign a score from 1 (minimum) to 5 (maximum) to each photograph admitted to the competition.
At the end of the preliminary phase, the 40 photographs with the highest score will be selected. During this phase, in the event of a tie, the date of the confirmation of participation will take precedence.
Those selected will be notified automatically by e-mail.


Art. 11. Selection - final phase

The jurors shall assign a second score (from 1 to 5) to the selected works, determining the finalists: the 5 photographs with the highest score. During this phase, in the event of a tie, the date of the confirmation of participation shall be decisive.
The finalists will be notified automatically by e-mail.


Art. 12. Selection - winner

The jurors assign a third score (from 1 to 5) to the selected works, determining the winner: the photograph with the highest score. During this phase, in the event of a tie, the date of the confirmation of participation shall take precedence.
The winner will be notified automatically by e-mail.


Art. 13. Copyright

The participant declares that he/she is the sole and exclusive owner of the photographs uploaded and that he/she possesses, should it be necessary, the releases due by law from the portrayed subjects, and assumes full responsibility in the event of claims made by the photographed subjects and third parties in general.


Art. 14. Use of the images

The photographs will remain the exclusive property of the author, who authorises the promoter to use, reproduce and publish them by any means, free of charge (excluding use for commercial purposes) and without time limits; in particular, but not limited to, on the promoter's websites, social networks, printed matter (flyers, posters, catalogues, books, ...), etc.
Each author undertakes not to claim any financial compensation for any publication of the photographs in books, magazines, newspapers, websites and/or social networks.
Prints of the photographs, if an exhibition is organised and if they are printed at the expense of the promoter, will remain the property of the promoter.


Art. 15. Responsibility

Responsibility for uploaded content lies with the authors of the content. The promoter declines all responsibility for images uploaded by users and for any copyright infringement.
In any case, in general, participating photographers undertake to indemnify and hold harmless the promoter from all claims, demands, liability, and in general from any and all rights or claims of third parties relating to and attributable to the content.
The promoter reserves the right not to publish images whose content is pornographic, violent or racially intolerant; is harmful to the privacy of others or to the image, reputation and honour of third parties or the law; is vulgar, racist, classist or in any way reprehensible; or may cause harm, in any way, to minors.
Even if already published, the images referred to in the previous point may be removed by the promoter, at its sole discretion and without notice and without any claim for reimbursement.


Art. 16. Provision of the Service

The Promoter reserves the right to interrupt or prolong the uploading and/or voting of works for any problem of a technical, organisational or legal nature.
In the event of early interruption of the competition, the works of those previously entered will be evaluated according to the rules contained in these regulations and in any case by the jury indicated.
Due to the specific structure of the Internet, in which many entities are involved, no guarantee can be given regarding the constant and complete usability of the site and related applications.


Art. 17. General terms and conditions

Legal recourse is excluded. Any disputes concerning the application of these regulations and the running of the competition that cannot be resolved amicably shall be submitted exclusively to the court of Lugano with the application of Swiss law.
No correspondence shall be entered into regarding the competition.
Participants acknowledge and accept the present general conditions of the competition.


Art. 18. Language

Should the English translation of these Rules differ from the Italian original, the Italian version is binding.
